Assault with a Weapon- Devine Street

On May 17 at 2am, Sarnia Police were called to an incident at the apartments located at 817 Devine Street in Sarnia. A male on the street (victim) was yelling at a resident inside an apartment.

On May 17 at 2am, Sarnia Police were called to an incident at the apartments located at 817 Devine Street in Sarnia. A male on the street (victim) was yelling at a resident inside an apartment. In response, a male (accused) appeared on one of the balconies with what appeared to be an "assault style" gun, pointed it at the victim, threatening him and telling him to leave.
 
After the accused went back into his unit, the victim made one more attempt to reach the person he was looking for. The accused once again returned to the balcony, this time with what was described as a "Dirty Harry" looking silver hand gun, again threatening the victim. The victim fled the area and reported this to Sarnia Police.
 
The accused was located and arrested without incident. Given the firearms allegations, the Criminal Investigation Division executed a search warrant at the accused's apartment. As a result of the search, several offensive weapons were located and seized. The weapons included numerous BB and airsoft style guns, including ones matching the description of those involved in this incident.
 
A 49 year old of Sarnia, has been charged and held for bail on the following offences:
  • Unauthorized possession of a firearm;
  • Pointing a firearm;
  • Possession of weapon for dangerous purpose;
  • Assault with a weapon;
  • Utter threats to caused death or bodily harm.
Suspect was remanded into custody and will appear next in court on Tuesday May 21, 2024.

General Information on Bail Hearings
"Held for bail" means the police chose to not release an accused person back into the community. However, as the police cannot hold a person in custody for longer than 24 hours, we are required to send them to bail court, where they will have a bail hearing. There, the presiding judge or Justice of the Peace will decide on whether the person should be released into the community or not.
"Released on bail" means the police held them in custody, but a subsequent release decision by the courts was made.
"Remanded" into custody means the accused was not granted release by the courts.
The bail system provides a framework to oversee and put limits on police custody. It is governed by legislation including the Criminal Code of Canada.
